§ 375. Equipment.

32.  The violation of any provisions of this section with respect to adequate brakes except those relating to emergency or hand brakes shall constitute a misdemeanor and the violation of any of the other provisions of this section, including those relating to emergency or hand brakes, shall be punishable by a fine not exceeding on hundred dollars or by imprisonment for not exceeding thirty days, or both such fine and imprisonment, except as herein otherwise provided.

35. Tires. (a) the commissioner [of motor vehicles] may establish standards . . . for the use of tires on vehicles operated in this state.

    (c) No person shall operate a motor vehicle or a trailer on a public highway if such vehicle is equipped with tires that do not meet the standards established by the commissioner pursuant to paragraph (a) of this subdivision.

§ 51.5 Tire Use.

(a) No motor vehicle, motorcycle or trailer (including a semi-trailer) shall be operated upon the public highways of this State on any tire having:
    (1) A fabric break, or a cut in excess of one inch in any direction as measured on the outside of the tire and deep enough to reach the body cords, or has ben repaired temporarily by the use of blowout patches or boots; or
    (2) any bump, bulge or knot related to separation or partial failure of the tire structure; or
    (3) any portion of the ply or cord structure exposed; or
    (4) a portion of the tread design completely worn, provided such worn portion is of sufficient size to effect the traction and stopping ability of the tire.
    (5) markings "not for highway use" or words of similar intent, or "for racing purposes only".
    (6) war to the point where less than 2/32 of an inch tread groove pattern depth remains at both points of which gauge readings are required by section 51.6 of this Part.
(b) Any tire on the front wheels of a bus, truck with a maximum gross weight in excess of 10,000 pounds or truck-tractor shall have a tread groove pattern depth of at least 4/32 of an inch when measured at both points at which gauge readings are required by section 51.6 of this Part.
(c) No bus shall be operated with regrooved, recapped or retreaded tires on the front wheels.
 

§ 51.6 Method of measuring tread groove pattern depth.

Tire tread groove pattern depth shall be measured by a tread depth gauge of a type calibrated in thirty-seconds of an inch.  Readings shall be taken in a major tread groove of the tire nearest to the center at two points of the circumference not closer than 15 inches.  Readings for a tire which has a read groove pattern running across the tire or for a siped tire, where such tread groove pattern is permitted, shall be taken at or near the center of the tire at two points of the circumference not closer than 15 inches.
